Making a purchase from this website and placing an order signifies that you have read and accepted these terms and conditions of sale.

Shipping Costs and Delivery Times

The products are delivered to the address indicated by the buyer in the order form, and only to the specified geographical destinations available for delivery.

All products are sent in perfect condition. The customer must notify the logistics company (or the delivery person) of any signs of impact (holes, crushing marks, etc.) on the package and, if necessary, refuse the package. An identical product will be sent at no additional cost.

Any claim for a product that has been declared as damaged during transportation, without any reservation being issued upon receipt of the package, cannot be considered.

Like with any shipment, there is a possibility of delay or loss of the product. In such cases, the logistics company will be contacted to initiate an investigation. Every necessary effort will be made, for as long as necessary, to locate the package. If necessary, the merchant will be reimbursed by the logistics company, and a new identical package will be delivered at no cost.

We decline any responsibility for delivery delays caused by the logistics company, especially in cases of product loss, adverse weather conditions, or strikes.

Shipments prior to holidays may be subject to delays by the transport companies. Orders placed before holidays may be processed on the next business day.

Delivery Issue by the Logistics Company

The consumer must notify VIN BOUQUET - NERTHUS on the same day of delivery or no later than the first business day after delivery regarding any delivery error and/or non-conformity of goods in terms of quantity or quality, compared to the information provided in the order form.

After this period, any claim will be denied. The submission of this claim to VIN BOUQUET - NERTHUS can be addressed to the address of VIN BOUQUET - NERTHUS.

The consumer must send a copy of the letter to the address of VIN BOUQUET - NERTHUS. Without this, no changes will be made.

Error in Delivery

After this period, any claim will be denied. The submission of this claim to VIN BOUQUET - NERTHUS can be addressed to the address of VIN BOUQUET - NERTHUS.

Any claim made in accordance with the aforementioned rules and after the specified deadlines will not be considered, and VIN BOUQUET - NERTHUS will not be held responsible towards the consumers.

The shipping costs will be covered by VIN BOUQUET - NERTHUS, unless it is proven that the product does not correspond to the original declaration made by the consumer, in order for the exchange to be correctly carried out.

Product Warranty

The provisions of these conditions cannot deprive the consumer of the legal warranty that requires VIN BOUQUET - NERTHUS as a professional to guarantee against any type of product defect.

The warranty period is two years (2 years). This warranty excludes all products repaired or modified by the customer or by any other company other than VIN BOUQUET - NERTHUS.

The warranty may be extended as provided in the store and on the website, in the workshop section.

Right of Withdrawal

The Customer has a right of withdrawal granted by law in the case of the purchase of goods, which is fourteen (14) working days from the date of receipt of their order. During this period, the Customer may return, at their own expense and without any penalty, the Product(s) that do not meet their expectations.

In this case, the Customer may choose between a refund of the amount paid, in exchange for the return of the Product(s), and the exchange of the ordered Product(s). It is understood that the returned Product(s), at the Customer's expense, must be in good condition, as they were delivered by VIN BOUQUET - NERTHUS.

Sensitive products (e.g., DVDs, CDs, software) must not have been opened in order for the consumer to exercise the right of withdrawal.

Only the prices of the purchased Product(s) will be taken into account, with the condition that the products are returned complete in their original packaging and in a similar condition to their original state. No return will be accepted if you have not contacted our services by email and obtained a return number. Any package sent without a return number (DMA - Authorized Material Return) will be rejected. In the absence of this agreement, VIN BOUQUET - NERTHUS will reject the receipt of any product with an incomplete return or without a DMA number. In any case, the costs and risks of the returns are borne by the customer.

Returns should be sent to the address of VIN BOUQUET - NERTHUS. The right of return cannot be exercised for: - Items returned incomplete, deteriorated, damaged, or soiled by the customer will not be accepted, or the refund amount will be reduced. Once the package is received by our services, the refund will be processed.

Reservation of Ownership

The use of registered trademarks on this site is strictly prohibited.

Force Majeure

Neither Party shall be liable for total or partial non-performance or delay in the performance of its obligations under this contract due to external causes beyond its control (Force Majeure).

Force Majeure shall include, but not be limited to: war, riots, insurrection, severe disruptions in internet security, technical failures, unauthorized access and/or intrusions on the Website servers, strikes of any kind, and telephone or computer failures.

If either Party invokes a Force Majeure event, it shall notify the other Party within ten business days of the occurrence or imminent occurrence of such event.

The Parties agree to maintain timely communication to jointly determine the terms and conditions for fulfilling an order, should a Force Majeure event occur.

After a one (1) month interruption due to a Force Majeure event, VIN BOUQUET - NERTHUS may decide to cancel the order(s), in which case it will refund the Buyer, if applicable.

Severability

If one or more provisions of these General Sales Conditions is deemed or declared invalid in accordance with the law, regulation, or an unappealable decision by a court of competent jurisdiction, the remaining provisions shall retain their absolute scope and validity.

Non-Waiver

If a party does not expressly state that it is unable to fulfill any of the obligation(s) listed in these general conditions, it remains obliged to fulfill said obligation(s).

Applicable Law

These conditions shall be governed by Spanish law, which shall apply to matters not provided for in this contract in terms of interpretation, validity, and performance.

In the event of a dispute or claim, the consumer shall primarily contact VIN BOUQUET - NERTHUS to seek an amicable solution.

Confidentiality and Data Protection

In compliance with the provisions of Organic Law 15/1999 of December 13 on the Protection of Personal Data, the personal data provided by the Buyer will become part of the customer file of VIN BOUQUET - NERTHUS, with the purposes of maintaining the contractual relationship, controlling and managing sales and corresponding payments. VIN BOUQUET - NERTHUS will treat such data with the utmost confidentiality and commits not to use them for any purpose other than that for which they were collected, as well as to store them with the necessary measures to ensure their security and prevent their alteration, loss, unauthorized processing, or access.

VIN BOUQUET - NERTHUS undertakes to maintain professional secrecy regarding the aforementioned personal data, even after the contractual relationship has ended.

The Buyer authorizes VIN BOUQUET - NERTHUS to retain their data for a period of five years after the completion of the contractual provision.
